Texting while driving - good public www exposure

Taking the bus often and driving in a tall vehicle, the amount of drivers texting is appaling as most of you know.

There are many examples out there already that have affected the drivers, occupations,etc...

I'm sure the police would take notice and the media along with the people.

Wondering about the legality of taking a picture of someone texting in their vehicle, the plate and posting it on sometype of blog-ish www. site. vancouvertexters.com or something.

I'm guessing that you could make the argument you are taking a picture of the vehicle (nothing illegal about that) and the person just happens to be in it and texting. That would be the most solid defense in case 2. below.

1. You can take a picture with someone in it ~ Aubry Vs. Éditions Vice-Versa Inc (a case within The Supreme Court of Canada). If the person is not the subject then permission isn't required. Unless a person has a reasonable expectation of privacy (such as in their home, or a bathroom, for example), then taking a photo would be considered criminal voyeurism.

2. You can take a picture with someone in it but it is possible they can take you to court over it, albeit extremely rare and unlikely. Personal Information Protection and Electronic Documents Act, which came into effect on Jan. 1, 2004.

So I'm assuming that all of those photo's were taken by the passengers of the vehicles, right? I would get at least 50 a week.. wow, at least!

Its funny, every time I drive in Alberta again I find it hard NOT to txt, or call, or clean the dust from the nooks on the dash... the roads are just too straight! I swear txting while driving is on the driving test there..

I just tell them on the PA to stop texting......(CB mics are legal to talk on while driving)...

To the driver who is not paying attention the PA seems like it should be coming from the police....who else has PAs?

One driver threw their phone in the back seat (they where texting and doing 45km/h in a 70 zone holding up cars.....

The one where the guy follows you home and proceeds to show you how to perform a colonoscopy using your Android. .......Just like texting while driving, road rage is illegal, but it doesnt seem to stop everyone.

when someone is texting while at the wheel, they will not notice someone outside of their vehicle taking a 1sec snapshot.

the website will be anonymous and anyone can submit the vancouverites texting

Here's an angle: Why is texting whilst driving illegal? Because it requires attention which should otherwise be directed to the driving, yes?

Would this not apply to focusing on a picture with your cell? All I'm saying is if you were focusing on the picture and in so doing drifted into the vehicle of the texter (which is quite possible and likely as the hand tends to follow the focus of attention)... This could require some explaining to the duty officer... and the judge... maybe the doctor, or the mortician.... family.... lawyer..... cell mate.... checkmate.....

I would think it better to note the vehicle registration and type, pull over and record it (when and where, too) then report it to the local RC constabulary and let them deal with it.
Just a thought.

I bet you $0.50 cents that nothing will get reported if you call in and say "I saw the driver of vehicle A with plates ABC 123 texting". You may get some laughter on the other end though.

Had a strange thing happen a few weeks ago while merging onto the Port Mann bridge in our Delica... my wife was looking up the ferry schedule on her iphone as I was trying to follow a semi as the lanes merged.

Suddenly a horn began to blare and I quickly went back into the merging lane wondering if I had cut someone off that I didn't see as I looked over at the other lane I saw a woman literally frothing at the mouth and banging on her window while pointing at her hand as they passed.

They then slammed on their brakes making me slam on mine and frantically look in my rear view mirror to make sure we were ready for being rear ended.

So I pulled alongside them, rolled down my window and asked what their problem was. The pony tailed driver then yelled back that texting while driving was illegal and about the same time he noticed that I was driving and not my passenger in the other seat (RHD).

I left out a few other incidents that occurred before this conversation that could have caused a serious accident.

It's interesting how these two were so convinced that my wife was texting, merging and driving at 80kph simultaneous that they felt that they should try run us over the side of the Port Mann bridge.

In retrospect it's funny, but when it was happening it was no joke.

Ya I had an older couple chase me in traffic in the Delica trying to get beside me...they where convinced my 8 year old was driving.....(and this was on a day when he did not have the Extra steering wheel and his window open)

They had a good laugh when they caught back up...

If a site is there I would use it. Heck! All I have to do is stand on any corner on Cambie St. (Vancouver) and I would get a couple of snaps a day. Like the J&$K with Ont. plates texting, turning right and just about tagging the wife and I.
