side exhaust illegal?

my local muffler shop said theyd redirect my exhaust out the side for $160 (so i can fit in a WVO tank.) they said its illegal because the tailpipe must come out behind the rearmost opening window.
i dont mind breaking the law, but i do have a rule about breaking only one law at a time.

Very simple solution,

Just lock your rear window so that it no longer opens... (until you need it then know how to easily de-activate your luck!)

Unless you have a sliding window I'd doubt you'd have any issue and even with a slider one... Especially that I didn't find anything about the side exhaust in the Motor Vehicle Act. There's lot of "don't do" in the MVA though, at the end it's up to you.

I have to agree, I have never seen anything to indicate a legal reason not to have a side outlet exhaust.
Though I do have to agree that having it further forward than an open window is probably a bad idea, and therefore something to keep in mind while driving.

The crown prosecutors are real lazy about that one. They usually use that as a giveaway when negotiating tickets. To much effort to get a conviction. (It wouldn't be that hard but they are just not interested in doing the work.)

Does 'vehicle' not include motorcycles, because there are a whole lot of them that are 'excessively noisy'. Of course, not many motorcycles have mufflers - tailpipes, but no mufflers.
